| - 现代民族国家框架内的法治国研究赋予个人权利以根本的重要性。与专制作斗争和尊重公民个人权利的自由的理念影响了整个公法领域，也同样影响了政治学和法学领域内的少数民族的权利概念。论文创新性地采取了“共同体到社会”的视角和方法来深入研究少数民族这一概念。一方面，少数民族共同体对现代自由观的抽象个人主义，尤其是对更广义的现代社会和国家提出和构成了严重的挑战。以中国的少数民族为基础，本文强调了少数民族意识如何被现代社会和国家所制造。另一方面，论文分析了共同体如何受到现代市场经济的影响：少数民族的个人在社会中担任不同的的角色，这种多维的角色对其文化认同和集体权利构成了质疑。因此，蕴含人类道德伦理价值的共同体必须屈从于现代社会背景下的个人主义的要求。在中国宪法的基础上，本文首先分析少数民族权利的性质，然后探讨中国的民族区域自治制度的合理性，尺度及其构建。
- La recherche de l’État de droit dans le cadre de l’État-nation donne une importance capitale aux droits individuels. Les idées de liberté, de lutte contre l’autoritarisme, du respect des droits de l’homme et du citoyen formatent ainsi profondément le droit public. Mais elles affectent aussi le droit des minorités dans le champ politique et juridique. Pour approfondir la notion de minorité, cette thèse analyse les rapports entre « la communauté et la société étatisée ». En premier lieu, la communauté minoritaire constitue un véritable défi pour la conception libérale abstraite de l’individu mais plus généralement pour le modèle de société de l’État moderne. À partir des minorités chinoises, la thèse souligne comment l’identité minoritaire est une création dans et par l’État moderne. En second lieu, la thèse analyse comment la communauté est dénaturée par l’économie de marché moderne : les individus appartenant aux minorités adoptent des comportements qui mettent en question leur propre identité culturelle et leur droit communautaire. Le système communautaire de valeurs éthiques et morales, doit ainsi se plier aux exigences de l’individualisme. Dans le cadre de la Constitution chinoise, la thèse analyse d’abord le principe générateur des droits des minorités, elle aborde ensuite la légitimité, la délimitation et la construction de l’institution d’autonomie régionale ethnique de la Chine.
- Individual rights are of utmost importance in the quest for the rule of law in the context of the nation-state. The ideas of freedom, struggle against authoritarianism, respect for human rights and citizen rights shape public law. However, they also affect the rights of minorities in the political and legal field. This thesis adopts the perspective of the \"community and a society dominated by the state\" to analyze the notion of minority. On the one hand, the minority community constitutes a real challenge for the abstract conception of the individual under liberal individualism theory, and more generally for the model of society of the modern state. Using Chinese minorities as an example study, the thesis highlights how minority identity is a creation in and through the modern state. On the other hand, the community is influenced by the modern market economy: people belonging to minorities adopt a different behavior that challenges their cultural identity and community rights. Therefore, the community system of ethical and moral values has to adapt to the requirements of individualism. In the framework of the Chinese Constitution, the thesis first analyzes the principle of minority rights, and then discusses the legitimacy, the limits and the construction of regional ethnic autonomy in China.
