| - Il existe une communauté de pénalistes qui œuvre à la constitution et à la transmission d’un savoir sur le droit pénal. Pourtant, la doctrine pénale demeure à découvrir. Son activité, son savoir-faire, son influence sur le droit, peuvent être appréhendés à partir d’une analyse de la littérature juridique. La notion de « présomption d'innocence » sert ici à délimiter le discours doctrinal à étudier. Quelle place cet objet de savoir et de connaissance y occupe-t-il ? Quel est le contenu des énoncés savants ? Ces deux questions permettent de guider l'analyse du discours. Bien que consacrée par la Révolution de 1789, la présomption d'innocence n’apparaît dans les ouvrages français de procédure pénale qu'au début du XXe siècle. Cette émergence n'est pas liée à l'état du droit positif mais à une réaction de la doctrine juridique aux critiques formulées par l'école positiviste italienne. Tandis que législateur et juge ne la formulent pas explicitement, la présomption d'innocence tire tout d'abord son existence juridique de sa seule présence dans la littérature savante. L'analyse du discours sur la présomption d'innocence révèle plus nettement encore l'influence de la doctrine pénale dans l'élaboration de ce concept. Par l'interprétation des sources historiques et positives du principe, la doctrine a davantage œuvré à l'affirmation de son existence juridique qu'à sa démonstration. Quant à la signification de la présomption d'innocence, elle se révèle indéterminée car incertaine. Celle du fondement du principe a été en réalité éludée. Or, seule une recherche du fondement de ce discours peut expliquer ce discours et permet de révéler la philosophie qui le sous-tend.
- A community of scholars is working to develop and to convey knowledge on penal law. However, the influence of penal scholarship remains to be discovered. Its operation, its know-how, its influence on the Law may be captured by an analysis of legal writings. The notion of “presumption of innocence” is used here to set boundaries of our exploration of legal discourse. Where does this object of learning and knowledge fit into the Law? What is the content of learned statements? These two questions will guide our analysis. Although it was evoked during the 1789 Revolution, presumption of innocence does not appear in French penal procedure books until the early twentieth century. This emergence is not linked to the state of substantive law but to a reaction of legal doctrine to criticism stemming from the Italian positivist school. Whilst the presumption of innocence was not formalized by the legislator or judges, it initially drew its legal existence from its mere presence in scholarly writings. The analysis of language on presumption of innocence reveals even more clearly the influence of penal doctrine on the development of this concept. Through interpretation of historical and statutory sources, the doctrine was emphasized more to affirm its legal existence then to further its content. As for its meaning, presumption of innocence shows its indeterminate nature as its content remains open. The meaning of its founding principles has effectively been lost. Hence, only research on the foundations of language may further our comprehension and help reveal its underlying philosophy.
