| - La thèse étudie l'éventail des réactions étatiques à un fait internationalement illicite depuis les contre-mesures - définies comme des réactions pacifiques au fait illicite en soi dérogatoires au droit - jusqu'à la légitime défense. Ces réactions constituent, toutes des conséquences du fait illicite. Elles ne peuvent donc se concevoir que par rapport à celui-ci. Le fait illicite en constitue le motif et le fondement. Les finalités des réactions décentralisées sont déterminées en fonction des caractéristiques du fait illicite. L'identification des états lésés ayant une qualité pour réagir ne peut être effectuée qu'en adhérant au concept de \"préjudice juridique\" et en tenant compte de la nature et de la gravité du fait illicite. Les conditions formelles préalables au déclenchement de la réaction doivent contribuer à réduire le subjectivisme des états et à contenir le risque d'escalade sans pour autant limiter exagérément les options de l'état lésé. Les réactions décentralisées sont généralement admissibles sur le fond lorsqu'elles ne portent pas atteinte à des normes hiérarchiquement supérieures à celle qui les autorise. Elles sont en revanche illicites lorsqu'elles se heurtent à des obligations absolues, voire impératives. Elles peuvent, sous certaines conditions, prétendre à une légitimité en cas de conflit entre principes de la plus grande importance pour la communauté internationale. Ce conflit conduit ainsi à une atténuation de la responsabilité de l'état qui réagit de façon à priori illicite.
- The thesis examines the range of unilateral reactions of states to an intrnationally wrongful act from coutermeasures - defined as the pacific reactions in themselves contrary to an international obligation - up to self-defence. These reactions are, all consequences of the intenationally wrongful act which constitutes their common cause. Their purposes and functions are objectively determined by the caracteristics of the wrongful act. The indentification of the injured states which are entitled to react connot be homogeneously carried out unless one adheres to the concept of \"legal injury\" and one takes into account the nature and gravity of the illicit act. The formal conditions preceding the lauching of the reaction must contribute to the reduction of the subjectivism of states as to the existence of the alleged wrong without unduly limiting the options of the injured state. If these preliminary conditions are fulfilled, the decentralized reactions will be generally admissible in principle if they do not conflict with a rule hierarchically superior to the one which authorizes them. They will be illicit if they are contrary to an absolue or peremtory obligation. In those are cases of conflict between basic principles of international law, the corresponding reactions although illicit, will be grandted extenuating circumstances.
