| - Le régime d'autorisation des établissements de santé est caractérisé par l'utilisation, par l'administration, de prérogatives de puissance publique. Il matérialise un processus de planification autoritaire. Or, les pouvoirs publics tendent aujourd'hui à favoriser une démarche concertée de planification. En cela il est en contradiction avec les orientations récentes qui tendent à privilégier le dialogue et la négociation au cours du processus décisionnel. Le développement des relations contractuelles entre l'administration et les établissements de santé et le maintien du régime d'autorisation rend complexes et peu cohérents ces rapports. L'analyse de la pertinence du maintien du régime d'autorisation a nécessité la recherche de ses fondements et l'étude de la capacité du modèle contractuel à se substituer au régime actuel d'autorisation.
- As regard health institutions regulations, the French administration resorts to State prerogatives and such regulations are the result of some authoritarian planning. Authorities now have a tendency to foster concerted approaches. In that sense, it is in contradiction with the present-day orientations which tend to make dialogue and negotiations part and parcel of the decision-ma king process. The development of contractual links between the administration on the one hand, hospitals on the other as well as the maintaining of the aforementioned regulations make these relationships: difficult and barely consistent. Throughout this research, the consistency of maintaining those regulations was out under scrutiny, as it required both the study of its founding principles and the ability for the contractual patterns to substitute for the current regulation system.
