| - En justice des mineurs, la decision intervient apres une enquete sociale qui peut etre complete par un examen medico psychologique. Devant une loi volontairement generale. Le juge des enfants tient compte de ces informations pour rendre sa decision, dans l'interet de l'enfant, meme si cette notion n'entre pas dans ses objectifs tels qu'ils sont definis par le legislateur. Certains magistrats font entrer dans leurs objectifs la reparation du mineur, d'autres s'en defendent, estimant que la reparation est du domaine psychologique. En premier lieu, eune etude statistique a ete menee sur 195 dossiers de tribunal pour enfants afind de determiner le poids de chacun des intervenants dans la prise de decision. La deuxieme partie du travail a consiste a soumettre a tous les intervenants sur la scene judiciaire un article a sensation sur un placement d'enfant. Les reponses aux questions ouvertes ont ete traitees par une analyse factorielle des correspondantces et une classification hierarchique ascendante. Celles-ci ont permis de montrer les representations de la reparation chez tous les intervenants, indiquant l'attente de chacun vis-a-vis de la justice des mineurs. La theorie de la reparation chez melanie klein donne quelques elements susceptibles d'eclairer le processus, et de guider la reflexion sur les procedures mise en place et sur le projet de reforme du droit penal des mineurs.
- In the right of underage the decision comes after a social inquiry which can be completed by a medical and psychological testing. Faced to an intentionnaly general law the children magistrate takes in account this information to give his decision in the interest of the child, even if this noion is not included in his function such as it defined by the legislator. Some magistrates include the underage's restoration in their objects, some not because they think that restoration belong to the psychological field. First a study was made with 195 files of the juvenile court in order to establish the weightof all people who take place in taking judicial decision. The second part of this job has consisted in giving to everybody taking place in judicial decision a sensationnal article about a case of legal surceillance. The answers to the opened questions were treated by a factor analysis of correspondences and by an ascending hierarchical classification. These techniques have shown how people taking place in judicial decision could imagine the restoration of minor and so they have shown each expectation of them regarding the justice for minors. The theory of restoration for melanie klein gives some indications which can clarify the process and guide the reflection about current procedures and about a future reform in penal right of minors
