| - Time continuously and irreversibly imposes itself on all things. The European Court’s decisions are doubly confronted to this reality. First, the factual and legal data that the judge has to know about in order to settle disputes are written in Time. Then, the decision itself has to be integrated to it. The function of trying is thereby put to the test by Time, in plural and varied ways. For they cannot entirely be submitted to it, nor totally be freed from it, this study tackles the task of estimating and assessing the degree of abstraction of the Court’s decisions regarding Time. The hypothesis defended is that this degree of abstraction is closely linked to the principle of effectiveness. However, it does not call for an homogeneous answer. On the one hand, the protection effectiveness demands a certain receptiveness of the decision-making process to the continuity of Time. The judge has then to align his decisions with the reality of the data submitted to him, which cannot be artificially limited to one isolated instant. The facts and the conventional norm are then understood in their own duration. On the other hand, the search of an extended application of the Convention – that would benefit its effectiveness – brings a disharmony between the effects of the decisions and the normal unfolding of Time. The ambition is then to rewrite the past in which the norm was violated as if it were reversible, and to demand the anticipation of the occurrence of a violation.
- Le temps s'impose continuellement et irréversiblement à toute chose. Les décisions de la Cour européenne sont confrontées à cette réalité sur un double plan. D’abord, les données factuelles et juridiques dont le juge doit connaître pour trancher un litige sont inscrites dans le temps. Ensuite, la décision elle-même doit s’y insérer. La fonction de juger est ainsi mise à l’épreuve de manière plurale et diverse par le temps. Parce qu’elles ne peuvent entièrement s’y soumettre, ni totalement s’en affranchir, cette étude s’attache à évaluer le degré d’abstraction des décisions de la Cour à l’égard du temps. L’hypothèse soutenue est que ce degré est étroitement lié au principe d’effectivité. Il n’appelle toutefois pas une réponse uniforme. D’un côté, l’effectivité de la protection commande une perméabilité du processus décisionnel à la continuité du temps. Il s’agit pour le juge de s’aligner sur la réalité des données qui lui sont soumises, ne pouvant être réduites artificiellement à un instant isolé. Aussi, les faits et la norme conventionnelle sont appréhendés dans la durée au sein de laquelle ils s’inscrivent. D’un autre côté, la recherche d’une application étendue de la Convention, au profit de son effectivité, appelle une discordance entre les effets des décisions et le déroulement normal du temps. L’ambition est alors de réécrire le passé dans lequel la norme a été méconnue, comme s’il était réversible, et d'exiger l’anticipation de la survenance d’une violation.
