De prime abord, le droit appr\u00E9hende l\u2019\u00E9thique comme une r\u00E9flexion collective organis\u00E9e, encadr\u00E9e, institutionnalis\u00E9e, un questionnement sur la finalit\u00E9 des sciences m\u00E9dicales et la recherche d\u2019un choix de soci\u00E9t\u00E9. L\u2019\u00E9thique constitue un appui pour la construction de la norme juridique et cr\u00E9e des liens entre la soci\u00E9t\u00E9, la m\u00E9decine et le l\u00E9gislateur. Elle serait une \u00E9thique \u00AB sociale \u00BB. La loi organise cette activit\u00E9 extra-juridique qui remplit une fonction ressource, dont le droit ne peut tirer que des b\u00E9n\u00E9fices. L\u2019appr\u00E9hension est plut\u00F4t proc\u00E9durale, la loi se pr\u00E9occupant essentiellement d\u2019en d\u00E9crire les composantes et la mise en \u0153uvre. L\u2019\u00E9thique est distanci\u00E9e, en marge de la loi.En second lieu, il sera aussi expos\u00E9 que l\u2019\u00E9thique n\u2019est pas seulement une notion envisag\u00E9e de l\u2019ext\u00E9rieur. Le droit a appr\u00E9hend\u00E9 l\u2019\u00E9thique en l\u2019inscrivant au c\u0153ur de la norme juridique, confront\u00E9 \u00E0 la n\u00E9cessit\u00E9 d\u2019encadrer et de r\u00E9guler l\u2019exercice de la m\u00E9decine, de la biom\u00E9decine et de la recherche sur la personne humaine. Ici, l\u2019appr\u00E9hension est plut\u00F4t prescriptive, traitant des principes devant guider les pratiques, proche de la moralit\u00E9. Cet autre versant t\u00E9moigne du r\u00F4le subsidiaire pris par le droit pour r\u00E9guler les pratiques. Elle est une \u00E9thique de la recherche ou une \u00E9thique m\u00E9dicale ramenant \u00E0 une obligation de conscience. "This study aims at understanding how the French law system has gradually incorporated the very complex notion of ethics, with a focus on French medical standards and regulations. At first sight, the law views ethics as an organized, supervised, and institutionalized collective reflection, a questioning on the purpose of medical sciences leading to a search for guiding rules prevailing the orientation of our society. Ethics becomes a support for the construction of the legal rule and creates links between the French society, medicine and the legislator. This approach generates what can be called \u201Csocial\u201D ethics. The judiciary organizes this extra-legal activity, which serves to provide new and fresh ideas, from which the law pulls profits. The rendition of ethics by the law is descriptive, the legislation concerning itself mostly with describing the components of the official institutions concerned with ethics and their implementation. Ethics is distanced, outside the law. Looking further in the texts and court decisions, ethics cannot be restricted to a notion simply external to the law. The law views ethics as the standards to be taken into account at the heart of the legal rule, which must build, order and regulate medical practices, biomedicine and medical research on human beings. Here, the system apprehends ethics in a prescriptive and censorial manner, stating principles that must guide the practice closer to morality. This other aspect demonstrates the supplementary role taken by the law system to regulate medical practices. This entails an ethics of medical research or a \u201Cmedical\u201D ethics deeply inspired by human consciousness. At this stage in the evolution of the French law system, this understanding of ethics, at the heart of the law, is more subject to variations, if not contradictions." .
