Elle assure, dans unesoci\u00E9t\u00E9 d\u00E9mocratique, la sauvegarde de l\u2019\u00E9difice normatif ainsi que la protection des droitset libert\u00E9s. Une justice ind\u00E9pendante et efficace est un symbole de l\u2019Etat de droit. Eller\u00E9v\u00E8le la r\u00E9alit\u00E9 de la s\u00E9paration des pouvoirs et consacre le r\u00E8gne du droit. Maisl\u2019efficacit\u00E9 de tout appareil judiciaire d\u00E9pend de la nature et de l\u2019ampleur des moyens dontil dispose. Or, dans nombre d\u2019Etats francophones, le syst\u00E8me judiciaire conna\u00EEt denombreuses faiblesses, li\u00E9es tant\u00F4t aux avatars des processus de stabilisationd\u00E9mocratique, tant\u00F4t aux situations plus fragiles de sortie de crise. La question durenforcement des capacit\u00E9s des institutions judiciaires se trouve ainsi pos\u00E9e. Et c\u2019est surcette base que l\u2019Organisation Internationale de la Francophonie (OIF) a investi, depuisune trentaine d\u2019ann\u00E9es, le champ de la coop\u00E9ration juridique et judiciaire. Ayant inscrit lapromotion de la d\u00E9mocratie au coeur de son action politique, la Francophonie a pris desengagements forts et d\u00E9velopp\u00E9, en s\u2019appuyant sur ses r\u00E9seaux institutionnels, desprogrammes destin\u00E9s \u00E0 accompagner ses Etats membres dans le renforcement descapacit\u00E9s de leurs syst\u00E8mes de justice. Cet engagement est perceptible dans le corpusnormatif de l\u2019Organisation. Il marque la ferme volont\u00E9 des Etats francophones d\u2019ancrerleurs relations dans un cadre de coop\u00E9ration, attach\u00E9 \u00E0 la protection des droitsfondamentaux et \u00E0 la r\u00E9gulation des pouvoirs majoritaires. "Justice is a fundamental attribute of modern States. In a democratic society, itguarantees the safeguard of the standard-setting framework as well as the protection ofrights. An independent and effective justice is a symbol of the rule of law. It illustrates theseparation of powers and establishes the primacy of law. But the efficiency of any judicialsystem depends on the nature and the extent of the resources at its disposal. Yet, inmany Francophone countries, the judicial system faces many weaknesses, sometimesrelated to the avatars of democratic stabilisation processes, sometimes to more fragilepost-crisis situations. So the question of the capacity development of the judicialinstitutions arises. For thirty years, the International Organization of La Francophonie(OIF) has entered the legal and judicial cooperation field on this basis. By including thepromotion of democracy at the heart of its political action, the OIF has indeed made strongcommitments and developed programs aimed at accompanying its member States in thecapacity development of their justice systems, thanks to its institutional networks. Thiscommitment can be seen in several statements of the Organization. It demonstrates thewill of the Francophone States to anchor their relationships in a cooperation framework,dedicated to the protection of fundamental rights and the regulation of majorities\u2019 powers.Today, justice is consequently established as a priority in Francophone concerns.
